I think the Fifth Circuit rule along the lines of the Supreme Court’s ruling in Looper contra the Chevron rulings. The agencies were not given law-making abilities which are also regulation making abilities beyond the preview of the law made by congress.
They cannot make regulations and rules beyond congressional permissions.
